FMLA and Disability Leave

Family Medical Leave Act (FMLA)

An employee is eligible to file for FMLA once they have been employed by the District forat least one year. An employee may use the Family Medical Leave Act (FMLA) for the following reasons:

1. Birth or adoption of a child;
2. To care for a spouse, child or parent with a serious health condition;
3. Employee’s own serious health condition that makes him/her unable to perform job functions.

 

This type of leave is UNPAID, unless you have State or Local leave to cover you while you are off work. If you have no local or state leave, you will be docked at your daily rate until you return to work. You may not return to work until you have provided the District with a full release to return to work.


The District’s share of your insurance premium will continue to be paid for the first 12 weeks the employee is off work; after that, the employee will be responsible for the entire premium. The employee's failure to pay the entire premium will result in the immediate cancellation of any and all insurance coverage. It is the employees responsibility to contact the Human Resources department at 210-945-5620 to make arrangements for payments while they are off work.

 

The maximum length for medical leave of absences, temporary disability, worker’s compensation, or maternity leave is 180 calendar days. Should you be unable to return to work as of the 181st day, your employment with the District will be automatically terminated.

Temporary Disability Leave (TDL)

A Professional Employee is eligible to file for Temporary Disability Leave (TDL) if they have been employed by the District for less than one year for the following reasons:

1. Birth or adoption of a child;
2. To care for a spouse, child or parent with a serious health condition;
3. Employee’s own serious health condition that makes him/her unable to perform job functions.

 

This type of leave is UNPAID, unless you have State or Local leave to cover you while you are off work. If you have no local or state leave, you will be docked at your daily rate until you return to work. You may not return to work until you have provided the District with a full release to return to work.

 

The employee will be responsible for their portion of the insurance premium as well as the District's portion of the premium. The employees failure to pay the entire premium will result in the immediate cancellation of any and all insurance coverage. It is the employees responsibility to contact the Human Resources department at 210-945-5620 to make arrangements for payments while they are off work.

Note: Any employee who is out for five (5) or more days must complete the FMLA/TDL paperwork.
